      Don't apologise, we have all been there with sleepless nights and worrying about it. It helps to come on here and be told not to worry and to have everything put in perspective. You may know what is right but hearing others say it reinforces what you know.

          You're not silly, stop beating yourself up about this. The important thing is to keep yourself and your family healthy and prioritize things.

          What it may be helpful to do is if/when things are tight financially is start posting on some of the other sections of the forum (e.g. the debt free diaries http://forums.all-about-debt.co.uk/f...t-Free-Diaries)

          AAD isn't just about dealing with creditors, theres lots of great people here who can help you with budgeting etc too, and help you prioritize things, so you don't have to fall prey to the payday loan vultures in the future.

          Why? What makes them different to any other company? They're not a doorstep lender that isn't regulated by the FCA who would really cause you bother, so, like any other company that is regulated by the FCA they have to operate within a set of rules and guidelines which are there to protect the consumer (you).           For now go silent, stop jumping to their tune. You need to take back control of this situation, and each time you react to their deadlines then you're not doing that. You can be 'co-operative' but it has to be on YOUR terms, not theirs. Not reacting to the 'threat-o-grams' is the first step to that.

          I know you've got a lot of personal stuff going on in your life right now, which is without doubt reducing your tolerance to dealing with this situation. Take a deep breath and ask yourself this - if all that other stuff wasn't going on how would you be reacting? I'm sure that it wouldn't be the same, I know this, you know this. So the way you build that tolerance right now is you give yourself some space, and that space you get from giving yourself time, and you get that time by not reacting to every letter/email that they send you. If they call/text ignore it. Most phones now you can create a contact, and set a ringtone/text notification for that contact to silent, or even to block and ignore, so do that!

          Yup, they are just normal procedural emails, with information that they are required to send you by law. So you can take comfort in this, in that you know that they know they have to operate within the law. This means you know that they know you're protected ok?!

          We've all been there, and we're all saying the same thing, so you know right now this is the right approach. At Christmas especially creditors and DCA's up the pressure on debtors because they know this is a good time of year for people to have some spare cash that they've been saving up so they're looking to get their hands on that. It is also for many companies the end of their calendar year, so they want to close their books and will have targets to meet.

                  Happy New Year to you & my friends.

                  I am sorry I have not been on the forum.

                  After my last post I received some devastating news that someone very close to me had a few months to live. I took this news as you can imagine..... However on Christmas Eve they passed, it was within a matter of weeks. Christmas and New Year has been dreadful and I have been left heartbroken.... The past few days the tears have eased a little, as I have sobbed & sobbed. Life can be so so cruel.

                  Whilst all this has been going on C4UN got in touch, and instead of ignoring them I panicked and offered £20.00 per month. I know I should not have done this.... They have requested an I&E which I have now put them off on 2 occasions as I really cannot sit down and do this at this moment.

                  They have now given me a deadline for this information to be with them by the 30/01/17.

                  I really wish I was a strong person.

                    I'm so sorry to hear about your bereavement. Perhaps you could write a short letter to C4UN explaining that you are under a lot of stress at the moment as you have suffered a recent bereavement which has caused you a great deal of emotional stress and could they give you some breathing space to deal with it.

                      Ok, what is done is done, don't beat yourself up over it. This is how these people operate - they prey on people who are at their most vunerable because those are their easiest targets.

                      My biggest concern is whether what you have offered is actually afforable for you? Have you gone through an I&E and checked that this is the case?

                      Personally I wouldn't divulge personal information like that to a creditor - unless it showed that you couldn't afford that offer, and it supported a lower figure.

                      See where I'm going with this? You called me, placed me in a difficult position, I was vunerable, made an offer under duress which I now realize I cannot afford, as you can see, this is what I can offer £x/month less.

                        Hello SnV,

                        I have not given them an I&E I just came up with this figure which would be OK. Are you saying not to submit an I&E. I have to submit this to them by the 30/01/17. However with all that is going on in my life I just cannot sit down & complete one. They state I have to submit one, however none f the other companies requested this and accepted my offer.

                        Please can you advise as I am struggling emotionally. It has been such a tough few weeks, so far this week it has been my lowest.

                          Hi Natty. You do NOT have to provide I and E information to anyone except a court but it's possible that they will refuse your offer if you don't provide one.

                            You don't have to submit anything to them. The arbitrary deadline they've given means nothing. Remember you don't dance to their tune.

                            So as has been said, you are under no obligation to provide them with an income/expenditure sheet, and infact anything they provide you is likely to be biased, and highly unlikey to adhere to the Common Financial Statement format. If you want to send them something then something like this would suffice (amend to suit):

                            Dear C4UN

                            Account Number xxxxxxxx

                            For future reference I request that all correspondence be kept in writing, and I will not discuss this matter or this account via telephone.

                            As you should be aware on xx/xx/xxxx, we discussed the aforementioned account, and it was agreed that due to my financial circumstances I was able to make an offer of £xx/month, however I have yet to receive written acceptance of this offer.

                            Please be advised that I have taken professional debt guidance and this is the maximum monthly payment I can afford and is a figure calculated based upon the industry recognised Common Financial Statement format, therefore there should be no reasonable for you to reject this offer, and I respectfully remind you of your obligations under CONC guidelines issued by the FCA.

                            I do not see any benefit to either of us to prolong this issue any further by demanding information that is inappropriate and irrelevant, or by refusing my reasonable offer and am sure you would agree the same.

                            I would really like to settle this issue amicably, and trust that my offer of £xx is accepted, and you provide written confirmation in due course. On receipt of this confirmation I will ensure that monthly payments will commence within 28 days, and will provide you with confirmation of the starting date.

                              Hello everyone,

                              I did not realise I had been away for so long.

                              I do hope everyone is well.

                              The loss I suffered at Christmas has deeply affected me and I am still grieving, it has been so difficult.

                              I have been dealing with my PDL disputes as best as I can, with the knowledge that SnV has provided. The information he has given me has been invaluable and I cannot thank him enough.

                              Just to provide an update: C4UN is resolved, when I say resolved, I mean I did not have to provide an I&E form and they have accepted £10.00 per month.

                              I have also also been dealing with Vivus (V7 Ltd) & Square Today.... I passed my complaint to the FOS for the V7 dispute. They have been useless, as we know. I have requested the case be passed to the Ombudsman, which I have been advised could take a few months. V7 have transferred my account to Credit Resource Solutions in the meantime.

                              Square Today have issued their final decision,h which is not in my favour, last week. I raised my complaint on the 15/09/2016 and they only responded on the 23/01/2017. I have been dealing with a company called Axcess Financial Europe that are part of Square Today & The Cheque Centre.

                              I would be grateful for any guidance regarding the above.
