Unenforceability Diaries

This is the section that you are free to post details of your diary, once you commence the Unenforceability route. This is a shared discussion area and other members will post words of support and pose questions, on your thread - we encourage this, the more people that share knowledge means the more people we have that understand the finer points of s.127.

If you want to start your own diary, then simply click Start a New Thread and start your diary. One of the experienced posters will come along and advise, as appropriate, usually on a daily basis.

If you've not had a reply then don't worry - this is a specialised field and not everyone will be able to help - you'll not have been forgotten (Site Admin moderate the UE threads as it is their speciality!)

Additional questions? Then simply click 'reply' and ask away, alternatively start your own diary here: Start a New Thread!

    * Please do not start a diary in this thread - this thread is for general questions regarding the diaries *

    Information I Need

    Requested Information for UE Process

If you're thinking of going down the UE route, then before commencing a diary please read the following information as it will help you to help me, which in turn means you'll get responses faster cos I can follow your progress with ease - the more complex you format your diary, the longer it takes me to respond cos I leave them till the end of the day when I think I'll have time, sometimes these sit unanswered for days because I struggle to find time.

Read the following useful guide on how to send me agreements:---> Sending your Agreement to AAD

To help me, to help you, please provide the following information for each account:

Type of account (credit card/loan)
Date commenced (ideally before Apr 2007)
Approx balance
Date last paid (approximate date you last made a FULL payment)
Are you on arrangement or not paying
Status (default/in arrears/up-to-date)
Account owner (who is writing to you, a DCA or the lender)
Providing the above information, for each account helps me. Then, when you start the process lay your diary out in a format like this example

    ---> Example of perfect layout

All you have to do is read down, you'll see Pixie has placed each account in its own post with updates in colour under each so when she updates these, it is easier for me to spot any changes and advise accordingly. We offer the starting point templates for free, for instance the main CCA Request template. However, to be able to access the CCA Request Replies and other popular templates you will need to subscribe to AAD+. Once you are subscribed then you will have access to all our template letters. Remember, you will need to send a CCA Request for each account. You will need a different CCA Request for an overdraft - Details Here.

When you get a CCA back, read this thread first then upload your agreement to our Unenforceability Checking Service-Online Portal. Please do not blank bits out. If you do not have a diary then we will not be able to check your agreement.

A word of caution. Just because a debt is pre 2007 doesn't make it automatically UE (albeit they usually are) - we'll help you to cross that bridge if and indeed when it is necessary.

      How to store info

Thanks to Drowning Not Waving - the below is very useful info...
Getting on top of the paperwork can be a full time job in itself, but once you're organised (I use a concertina box file and labelled each pocket for each creditor) it becomes much easier and a fairly simple process -

Open letter
Staple envelope to letter
Date it with date actually received
Read it
Update your own records and/or records here
Reply if necessary
File letter along with your response (most recent correspondence goes at the front of mine for easy referral)
Done!
Good luck with it all :beer
