A few weeks back I was caught speeding doing 50 through some roadworks ....limits was 40 mph

    Been given options

1 Educational course £70 to £100 no points
    2 £100 fine 3 points
    3 Go to court

    20mph 24mph 35mph
    30mph 35mph 50mph
    40mph 46mph 66mph
    50mph 57mph 76mph
    60mph 68mph 86mph
    70 mph 79mph 96mph

my question can they prosecute me in court for doing 50 in a 40 ?????

Yes. Short answer! Depending on how bloody minded they are, they can prosecute for any offence no matter how small. The guidance is only guidance.

I know of a chap prosecuted for 40 in a 30, don't know the outcome though.
if you do it today and you like it you can always do it again tomorrow

Depends if they had a temporary order in place to make the reduced limit enforceable.

                  Re: Speeding

The second part of the table is for going straight to court rather than court in general. So any speed can go to court but in order to stop the courts getting flooded, they issue fixed penalties which removes most of the lower levels from the courts as people generally either take the speed awareness bribe or take the 3 points. They will go to court if you don't take the offers.
