    Another win against PRA Group (UK) Limited at trial in Dudley County Court 9.5k small claims- won on prelim issue of assignment - awarded costs as well
    I am a solicitor Advocate who specialises in consumer credit and my firm is Joanna Connolly Solicitors. My leading case of Carey v HSBC set the legal precedence for creditors compliance with s.77 & s.78 Consumer Credit Act 1974 statutory requests & enforcement of debts in court.

            I think the important thing to note is that this case was won on a preliminary issue (the assignment not proved) without the DJ feeling the need to rule on all the other legal arguments.

            This demonstrates that a credit agreement which is 'enforceable' does not necessarily mean a claim can't be defeated in court where there are assignment and other legal issues.

                Oh Dear, never mind haha

                It's great when, as you say Di, cases prove there are far more arguments to have than just the agreement. You really would think they would get their houses in order- lets hope that they don't
