    Hi

    This is my diary. Trying to clear debts with a F&F settlement offer but want to negotiate, sent CCA request recently to be in a better position to do this. I have about £30000 debts with 6 debtors.

    Barclaycard
    • Credit card
    • Date commenced-around 2005
    • Approx balance-£3100 approx
    • Date last paid - 2008 approx
    • Are you on arrangement or not paying-Stopped paying May 2018
    • Status-last default in dec 2007
    • Account owner Barclaycard
    24/04/18 - sent CCA request using your template with £1 postal order
    25/04/18 - signed for by Cabot
    20/08/18 - letter from Cabot saying they have not received payment
    1.02.2020 - regular letters, numerous phone calls and texts requesting payment.

    25/05/18- letter from Wescot account now being managed with them
    02/08/18 - letter from Wescot saying they have not received payment
    16/08/18 - letter from Wescot saying they have instructed by there client HBOS to discuss outstanding balance with me
    23/08/18 - letter from Wescot. Important reminder asking me to contact them.
    02/09/18 - Reduced settlement figure if I get in touch letter from Wescot.
    09/11/18 - CCA letter received from Halifax. Have sent to Niddy to look over.
    09/11/18 - Niddy says it looks good and is .
    Jan 2019 - Debt now with CSL
    Feb 2020 - Heard nothing

      26/08/18 - letter returned and told to write to Lloyds
      2.05.18 - sent CCA to Lloyds
      9/05/18 - Letter returned and have been asked to send a CCA request hand signed
      20/05/18 - sent another CCA letter with a squiggle on it.

        28/06/18 - cca from Moorcroft will send to Niddy to look at.
        30/06/18 - Niddy says Virgin branded MBNA credit card.
        11/09/18 - Letter from Moorcroft asking me to contact them.
        17/10/18 - Letter from Moorcroft asking me to contact them.
        02/11/18 - Reduced settlement offer of 40% letter received.
        Dec 2019 - Letter from Arrow (account statement)
        Feb 2020 - Debt now with Drydensfairfax.

          2/05/18 - they have sent 30.pages of terms and conditions with an internet application I originally completed. My DOB is
          wrong though.
          12/05/18 - Niddy says
          17/10/18 - Get in touch letter from NCO.
          18/10/18 - Get in touch letter from NCO RESOLVE.
          27/10/18 - Statement of account from AMEX.

            30/04/18 - received a letter from Santander saying they are unable to locate my account. Not sure why the letter came from Santander.

              Cahoot are part of Santander which will be why they have sent you the reply

              So I wonder where your 15.19 payments have been going.

              Have you moved at all since you took out the loan, if so this may be why there is some difficulty locating you.

              Are you sure they debt has not been sold on at some point?

              You say the loan was taken out around 2006, is that an accurate guess or just a guess?
              Have you been getting statements of account from anyone showing receipt of the money

                Is this an Amex card or maybe a nectar card run by amex?

                Again, are you sure NCO are the owners and it is not still owned by Amex with NCO being the debt collector

                  I would wait but again, Moorcroft, are , as far as I know just debt collectors and not the actual creditor.

                  Did they actually mention MBNA or just our client

                  Who, if anyone is reporting on your credit file?

                    There is no lawful reason to force you to sign the CCA request and in the past I have told creditors that, sometimes it is useful to just sign it, slightly alter your signature and keep a copy of the letter

                      generally, and this is what I did so it is up to you

                      Once they have not complied with your CCA request I stopped payments - that was a little over 6 years ago.

                      Things will get harry for a while with lots of phone calls and letters but they can be dealt with.

                      If they do respond to your request then reevaluate

                        In my opinion, I have said what I would do on another of your threads

                        It is still very early days

                        I do think things you need to check is exactly who owns each debt and when the accounts were defaulted if they have ever been

                        If it helps you, I had 45K of debt and I started the process a little over 6 years ago, now, nearly all my debts are statute barred
                        I did have one case go to court and Joanna Connolly solicitors represented me and we defeated the claim - that started about 12 months ago and ended earlier this year

                          It was a nectar credit card. When I asked for the CCA AMEX replied saying the account has ben cancelled and referred to an outside agency. I think it is NCO as the debt collector.

                            I have moved several times since taking out the loan but I gave them the account number on the CCA letter. The only receipt of money has been on a monthly statement from Stepchange. It is only a guess when I took out the loan, my last default was in 2007 so it must have been around 2006 as I was paying it off properly for a while.

                              Noone is reporting on my credit file. My last default for this account was in December 2007. Moorcroft say "from our client" in their letter.
