  • Statute barred

So out of the blue my mother in law has received a letter from Capquest saying she owes 12k on a credit card. She remembers having the card but this was taken out in 2002. She then moved to Greece for 12 years where she doesn’t remember using or paying anything off the card. She returned back to the UK 4 years ago. She thought the card was paid off prior to her going to live in Greece. My question is as no payment has been made for the best part of 15 years am I right in thinking this will be statute barred and should she point this out to them or or not? Any advice will be greatly appreciated.

      Who was the original creditor?

Before pointing out anything to Capquest she needs to be certain of the facts.

You say she didn't use the card after she left for Greece but could there have been ongoing PPI premium/payments etc.?

She believes that she paid off the balance when she went to live in Greece but did she actually close the account (it doesn't need to be used to be 'live').

Is this the first contact she's had about this credit card since she returned to the UK in 2014?

        Hi Di

It looks like the original creditor was the Halifax.
As far as PPI is concerned she doesn’t know. No payments of any kind have been paid since she left the uk in 2002.
She really can’t remember closing the account.
This is the first contact since 2002.

        Thanks

I see no harm in her ignoring that letter if it's the first one.

With any luck it'll be the last one
