    Thread for those who are being chased by the above in order that we can all support & update latest events relevant to this DCA/Debt Purchaser, by recording events as they happen,

    In my O.H. case letter from Red account passed to Hamptons = so await their letter,


    Hope in the Secure legal Area???

    Letter bombardment by Lowells as has been reported as to what to expect on another forum - forget where;-

    Lowells = 1 x letter on letterhead from original creditor.
    about 5 or 6 on Lowells letterhead claiming to know what you wear and when.
    3 on Red DCA paper = Lowell in Drag.
    3 from Hampton!s legal = Lowell wearing False Teeth.
    1 from Lowell (swan song) : sometimes this step is omitted.

    2014 - Letter received from Lowells stating :- we have tried to help etc etc etc, & stated we will escalate your account to Red Debt Collection Services . an internal collections division of Lowells Ltd.
    Red will access your account/credit file & your commitments to make a recommendation on how to recover the outstanding balance , this could include legal action.
    Its not too late, we are willing to accept any repayment arrangement blablabla

    /2014 - Letter from RED (prepared it seems 031014) Recovering what you owe. = we specialise in assessing accounts for litigation etcetcetc., if you do not pay what you owe you could risk legal action, We may decide to apply for CCJ bla bla bla

    We prefer to avoid such action,& settle the matter (by robbing you)




    Updated to-day to show missing page of 17/03/2014 from Freds.

    2014 - Letter from Red = A Discount off your Balance, pay us 70% of Balance or pay £2.00 per day equivalent to £60 per month, If we do not hear from you in the next 10 days, we will instruct Hamptons Legal.

    /2014 - Letter from Red to-day = We are giving your account details to Hampton Legal ( Next Drawer no doubt), our pre-legal collections department.

    Note they state:- quote:- Our recommendation could be to apply for a CCJ & if this remains unpaid then:-

    Apply for the value of the debt to be secured on your property, or Apply to recover money you owe by making deductions directly from your earnings. or Instruct Bailiffs to remove goods from your home to the value of your debt.

    An alternative to the above a Field Agent could visit you to discuss payment face to face.,

    You can avoid the actions etc etc etc.,

    Agree payment plan etc etc etc.,

    Update to-day.

        Lowell...1st September..... Threatening CCJ Charging Order

        Deepie...SWID letter sent

        Lowell...14th September ....I'm afraid we have not received a copy of your CA from Cap One yet

        Lowell...28th October .....We enclose a copy of your original CA with Cap One ....
        Please find copy statements for your perusal and retention.
        Lowell purchased this account and are entitled to receive payment.

        They send copy of application form with some T/C and statements ..............

        Going to wait until the 15th and send-----------> Application Form Received

          Unless you contact us to arrange repayment, Alternatively you can visit Lowells website xxxxxxxxx pay in full or Direct debit affordable monthly debit.
          Unless you contact us to arrange payment, we may refer your account to a debt collection agency who will contact you to discuss payment. If you do not agree a repayment plan, they may then instruct their solicitors to initiate legal proceedings which could include applying for a county court judgment cCJ against you.

              A Red/Hampton/Lowell support group. Looks like a good place to detail my dealings with these numptys on a case I dealt with on behalf of my brother who emigrated to Australia. His dog was taken ill in quarantine so he used his Cap1 card to pay the vets bills but didn't pay Cap1 back. He rented out his UK home to friends who passed me the letters to deal with.

              This might be useful to give a guide of what kind of letters to expect along the way.

              May 2012: Cap1 statement of default issued owing £700 (ignored)
              Nov 2012: Credit Solutions - pay up or else (ignored)
              Dec 2012: Credit Solutions - a nicer tone asking if we need more time to pay just give us call (ignored)
              Dec 2012: Power2contact - we're going to visit your address to collect (ignored)
              Dec 2012: Credit Solutions - Opportunity to save 30% (ignored)
              Jan 2013: Credit Solutions - We've done trace investigations so pay up now (ignored)
              Jan 2013: Power2Contact - another home visit threatened (ignored)
              Feb 2013: Credit Solutions - another 30% off letter (ignored)
              Mar 2013: Cap1 - your account is no longer been managed by the dca appointed, keep up the repayments (ignored)
              May 2013: Cap1 - to inform we have sold your account to lowell
              May 2013: Lowell - hello we own your debt, please pay (ignored)
              May 2013 Lowell - please, please pay (ignored)
              Jul 2013: Lowell - please, please pretty please pay (ignored)
              Jul 2013: Lowell - we're going to get nasty if you don't pay (ignored)
              Aug 2013: Red - threats of ccj if you don't pay (ignored)
              Aug 2013: Red - Discount, pay us 70% of your balance (ignored)
              Sep 2013: Red - we're going pass it to hamptons if you don't pay (ignored)
              Sep 2013: Hamptons - threats of court & ccj if you don't pay (ignored)
              Oct 2013: Hamptons - we are now deciding the best course of action to recover the money (ignored)
              Oct 2013: Lowell - we are now preparing to pass your account for potential legal action (ignored)
              Nov 2013: Fredrickson - pay now or we instruct our solicitor (ignored)
              Nov 2013: Bryan Carter - we have been instructed, pay now or else (Not ignored)

              This is the time not to ignore as I know BC does issue claims so decided to sent BC a letter informing him that brother does not reside at that address or any address in the uk as he emigrated to Australia 2 years previous. I also enclosed a Form of Authority signed by brother allowing me to act on his behalf and for BC to direct any further comms direct to me at my address.

              Dec 2013: BC - letter to my address asking for brothers payment proposals otherwise collection activity may resume.

              I inform BC that brother has no knowledge of any debt to lowell and also enclosed a CCA request + £1 fee

              Jan 2014: BC return my £1 saying any cca request must be requested from our client lowell - I re-send it to lowell
              Jan 2014: BC - letter to my address, we require brothers payment proposals by 20 Jan
              I reply I still await CCA.

              Mar 2014: BC - letter to my address enclosing brothers agreement & statements covering Apr 2000 to Jan 2014.

              I'm getting tired of this so I inform BC that he is already aware that brother is a non uk resident and as such the UK courts have no jurisdiction over this matter and any attempt to obtain judgment will be met with an application to the courts contesting jurisdiction with costs.

              Jun 2014: BC - letter sent to brothers old uk address informing that BC have now issued court proceedings and a claim form is on the way.
              What an underhand twat BC is. He's been previously corresponding with me using my home address but when it comes to issuing a claim he uses my brothers old uk address in full knowledge that he resides in Australia and doesn't live there.

              Jun 2014: Court claim arrives at brothers old uk address but luckily it's handed to me before BC has the chance to obtain default judgment.
              We login to MCOL and complete the AoS. We put Brothers Australian address and indicate I intend to contest jurisdiction.

              I write to BC to inform him what a naughty boy he is to try and obtain default judgment in this manner and that Brother has completed the AoS to contest jurisdiction and all evidence will be provided to the court showing that BC issued the claim in full knowledge of brothers non uk residency. As we only had 14 days from AoS to submit application contesting jurisdiction, I gave BC a deadline of 7 days to discontinue otherwise application will be submitted + full costs as well as any counsel fees should it be necessary for brother to appoint local Counsel to represent.

              Jun 2014: Brother receives at his Australian address a Notice of Transfer of Proceedings from the court - "To all parties, this claim has been transferred to the county court at leeds as the claim is outside of CCBC jurisdiction."

              7 days later: BC - please find attached a copy of the notice of discontinuance forwarded to the county court at leeds.

                  XX/XX/XXXX - Lowells letter received to-day:- They are treating the last letter we sent i.e. Formal letter before action as a Complaint. & Passing to customer services who will investigate and get back to O.H., and may request further information from O.H. or provide with an update.

                  If we can contact you by phone, we will be able to discuss your concerns directly with you and hopefully agree a resolution with you verbally. This the quickest and easiest way for us to resolve this for you.

                  Enclosed copy of internal complaints procedure (bit on back of letter), only.

                  I would like to assure you that the account will be placed on hold, and we will stop all collections activity whilst dealing with your complaint.

                    09/01/2015 - Package from Lowells arrived to-day containing all we had previously from Capital One, hence the Prescribed terms letter sent to them (Capital One) originally, also copy off the letter of introduction of assignment from Lowells/Capital One, also statements = all the things sent by Capital one originally. their final response.

                    Account on hold 30 days for you to respond.

                      Received letter this morning from Lowell.......long winded one

                      In a nutshell .....with a view to achieving a quick resolution of this matter we will not take any further action to recover this debt and will now close the account
